Property Ownership
What Foreigners Can Own in Thailand
Freehold Condos
Foreigners can own condo units outright in freehold title — the clearest ownership structure available in Thailand. The 49% rule applies per building: no more than 49% of a building's total floor area can be foreign-owned.
- Full freehold title in your name
- Resale and inheritance rights
- 49% foreign quota per building
- Best liquidity of any Thai property type
Land & Houses
Foreigners cannot directly own land in Thailand. The two common structures are a 30+30+30 year leasehold (up to 90 years) or purchasing through a Thai limited company in which you hold shares.
- Leasehold up to 30 years (extendable)
- Thai company structure for villas
- Usufruct rights for long-term security
- Seek specialist legal advice on structure
Tax Considerations
The 180-Day Rule — What You Need to Know
Under 180 Days Per Year
If you spend fewer than 180 days per calendar year in Thailand, you are not a Thai tax resident. You owe no Thai income tax on foreign-source income. This makes Thailand extremely attractive for part-time residents and investors who split their time across multiple countries.
Result: 0% tax on foreign income
180 Days or More Per Year
Tax residents (180+ days) are subject to Thai income tax on foreign income remitted to Thailand in the same tax year — a rule that changed in January 2024 under Departmental Instruction Por.161/2566. Income earned and remitted in a prior year is not affected.
Result: Foreign remittances taxed at 5–35%
Thai tax law is complex and evolving. Always consult a qualified Thai tax advisor before making a decision.
